In this small volume Professor Fuller traces the evolution of an idea deriving from the Viennese physician, Franz Anton Mesmer, through nineteenth-century American popular culture. What began with Mesmer as a thoroughly materialistic and antitheological theory of medical healing ended the century in America as a dualistic theory with the New Thought movement emphasizing the spiritual powers of the mind to control matter. 1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

Taming the power of Wall Street was a principal campaign theme for Franklin Delano Roosevelt in the 1932 election. Roosevelt's election bore fruit in the Securities Act of 1933, which regulated the public offering of securities, the Securities Exchange Act of 1934, which regulated stock markets and the securities traded in those markets, and the Public Utility Holding Company Act of 1935 (PUHCA), which legislated a wholesale reorganization of the utility industry. The reform effort was spearheaded by the newly created (...) Securities and Exchange Commission, part of the new wave of experts brought to Washington to rein in business. PUHCA also marked the federal government's first significant incursion into corporate governance, with a corresponding reduction in the traditional role of investment bankers. The SEC's ascendance over the investment bankers was reinforced during FDR's second term by the Chandler Act of 1938, which provided the agency with a broad role in the bankruptcy reorganization of troubled companies.Enacting those statutes was only the beginning, as the scope and effectiveness of the SEC's regulatory efforts depended critically on navigating these new statutes past an initially hostile Supreme Court. After substantial delay in the lower courts, the securities statutes eventually got a friendly hearing in the Supreme Court, where a number of Justices came to the Court after serving as the "Founding Fathers" of the federal securities laws. Roosevelt's Supreme Court nominees were involved in drafting the new legislation, securing its passage in Congress and implementing a litigation strategy that successfully stalled final determination of the constitutionality of the securities laws until New Deal appointed justices were in place. Felix Frankfurter played an important role in shaping the Securities Act and PUHCA, and was a key advisor on litigation strategy to the Roosevelt administration. Hugo Black led the legislative battle to enact PUHCA against the utility companies. Stanley Reed and Robert Jackson were key courtroom advocates arguing PUHCA's constitutionality. William O. Douglas headed the study of Protective Committees that led to the Chandler Act and was Chairman of the SEC. In this article, we explore the role of the New Deal justices in enacting the securities laws, litigating the challenges brought against them and then interpreting these laws in securities cases before the Supreme Court. We show the important role that these New Deal justices played in ensuring a broad scope for the federal securities laws through generous interpretation. Once constitutional questions had faded, securities cases proved to be a critical testing ground for newly emerging theories of administrative law. We demonstrate the split over the importance of judicial review versus deference to the rule of experts that emerged among these Roosevelt appointees. Finally, we explore the relative lack of influence of Douglas and Frankfurter in these cases, despite their familiarity and experience with the securities laws. (shrink)

An analysis of social goals for agriculture presupposes an account of systematic interactions among economic, political, and ecological forces that influence the performance of agriculture in a given society. This account must identify functional performance criteria that lend themselves to interpretation as normative or ethical goals. Individuals who act within the system pursue personal goals. Although individual acts and decisions help satisfy functional performance criteria, individuals may never conceptualize or understand these criteria, and, hence, social goals for agriculture may not (...) be intentionally sought or desired by any human being. The statement of social goals is not, therefore, reducible to statements about individual desires and preferences, and the validity of social goals does not depend upon deriving a social welfare function, nor upon measuring interpersonal utility.The paper examines a series of strategies for defining social goals for agriculture, beginning with the statement of goals offered by William Aiken in 1983. Aiken's view stresses individually based constraints upon action, but social goals cannot be adequately defined on this view. Successively more adequate approaches to the problem of social goals are examined with respect to production and efficiency, Jeffersonian democracy, and ecosystem goals of community and self-reliance. The role of family farms, and the change in farm structure is evaluated in light of this analysis for social goals. (shrink)

Imperative sentences like Dance! do not seem to represent the world. Recent modal analyses challenge this idea, but its intuitive and historical appeal remain strong. This paper presents three new challenges for a non-representational analysis, showing that the obstacles facing it are even steeper than previously appreciated. I will argue that the only way for the non-representationalist to meet these three challenges is to adopt a dynamic semantics. Such a dynamic semantics is proposed here: imperatives introduce preferences between alternatives. This (...) characterization of meaning focuses on what function a sentence serves in discourse, rather than what that sentence refers to (e.g., a state of the world). By representing the meaning of imperatives, connectives and declaratives in a common dynamic format, the challenges posed for non-representationalism are met. (shrink)

A uniform theory of conditionals is one which compositionally captures the behavior of both indicative and subjunctive conditionals without positing ambiguities. This paper raises new problems for the closest thing to a uniform analysis in the literature (Stalnaker, Philosophia, 5, 269–286 (1975)) and develops a new theory which solves them. I also show that this new analysis provides an improved treatment of three phenomena (the import-export equivalence, reverse Sobel-sequences and disjunctive antecedents). While these results concern central issues in the study (...) of conditionals, broader themes in the philosophy of language and formal semantics are also engaged here. This new analysis exploits a dynamic conception of meaning where the meaning of a symbol is its potential to change an agent’s mental state (or the state of a conversation) rather than being the symbol’s content (e.g. the proposition it expresses). The analysis of conditionals is also built on the idea that the contrast between subjunctive and indicative conditionals parallels a contrast between revising and consistently extending some body of information. No existing conditional semantics captures the dual role of 'if' in embedded interrogatives — 'X wonders if p' — and conditionals. This paper presses the importance and extent of this challenge, linking it to cross-linguistic patterns and other phenomena involving conditionals. Among these other phenomena are conditionals with multiple 'if'-clauses in the antecedent — 'if p and if q, then r' — and relevance conditionals — 'if you are hungry, there is food in the cupboard'. Both phenomena are shown to (...) be problematic for existing analyses. Surprisingly, the decomposition of conditionals needed to capture the link with interrogatives provides a new analysis that captures all three phenomena. The model-theoretic semantics offered here relies on a dynamic conception of meaning and compositionality, a feature discussed throughout. (shrink)

This paper proposes a semantics for free choice permission that explains both the non-classical behavior of modals and disjunction in sentences used to grant permission, and their classical behavior under negation. It also explains why permissions can expire when new information comes in and why free choice arises even when modals scope under disjunction. On the proposed approach, deontic modals update preference orderings, and connectives operate on these updates rather than propositions. The success of this approach stems from its capacity (...) to capture the difference between expressing the preferences that give rise to permissions and conveying propositions about those preferences. This article describes the racial integration of Emory University and the subsequent creation of Pre-Start, an affirmative action program at Emory Law School from 1966 to 1972. It focuses on the initiative of the Dean of Emory Law School at the time, Ben F. Johnson, Jr.. Johnson played a number of leadership roles throughout his life, including successfully arguing a case before the United States Supreme Court while he was an Assistant Attorney General of Georgia, promoting legislation to create Atlanta (...) 's subway system as a state senator, and representing Emory in its lawsuit to strike down the state statute that would have rescinded its tax exemption if it admitted African American students ). This account supplements my related article on Pre-Start, "'A Bulwark against Anarchy': Affirmative Action, Emory Law School, and Southern Self-Help", providing more information about historical context generally, and particularly about Emory v. Nash. Johnson was ambitious for Emory as a whole, and particularly for the Law School, and he saw in segregation the single largest impediment to making Emory a nationally prominent research university. The story of Emory's integration, and Johnson's leadership, requires revision of the prevailing story of integration generally, and especially of universities. Integration at Emory came about because of the pressure that African Americans and their supporters created through the civil rights movement, but Emory administrators responded to such pressure more constructively than most. Their actions provide an interesting case study in effective leadership during a period of significant moral and political conflict. (shrink)

We live in an era that often described as 'therapeutic.' Our culture is suffused with unconscious fantasies and psychoanalytic ways of thinking about self, other, and society. Aspects of the Freudian cultural universe have also had an impact on how we think about religion. In this volume, William Parsons explores the relationship between religion and psychoanalysis through multiple, linked investigations. Why did Freud write about religion and what did he say? What were the multiple critiques levelled at his work? (...) What were the post-Freudian psychoanalytic advances? How can we still apply psychoanalytic ideas going forward? In answering these and related questions, Parsons distinguishes between classic-reductive, adaptive, and transformational psychoanalytic models. As America's debate over federal funding of embryonic stem cell research continues to deepen, it is increasingly characterized as a conflict between the objectivity of secular science and the cultural variability of traditional religion. Yet science alone, by the very limitations of its naturalistic methodology and domain of knowledge, is unable to draw its own moral boundaries. Through a careful consideration of the relationship between scientific knowledge and our most fundamental assumptions concerning the moral value of developing life, we may (...) discern the terms of a possible resolution to our current conflict. In May 2005, the President's Council on Bioethics issued a report "Alternative Sources of Human Pluripotent Stem Cells," that discusses four proposals for a technological means of obtaining pluripotent stem cells without the destruction of human embryos. Drawing on the principles laid out in this report we discuss one of these proposals, Altered Nuclear Transfer, as a way forward that can sustain social consensus while opening avenues for scientific advance. The French philosopher Michel Foucault's work has had a significant impact on feminist and lesbian/gay scholarship in the United States. These explorations of gender and/or sexuality in which feminist, lesbian, and gay scholars rely on Foucault's ideas carry significant implications for the organization of knowledge in our culture beyond the issues of gender and sexuality narrowly defined. Many feminist, lesbian, and gay scholars in the United States initially read Foucault primarily as a historian. Since roughly 1985, many such scholars have (...) increasingly considered and critiqued the philosophical implications of his work, elaborating an account of the assumptions about gender and sexuality that reside at the core of ostensibly universal descriptions of human subjectivity. ;Participants in debates about the "social construction" of sexuality during the 1980s observed that Foucault did not originate social constructionist work in the field, widespread assumptions to the contrary notwithstanding. Indeed, the social constructionist position differs importantly from Foucault's analysis of sexuality as the truth of subjectivity. Historians in the United States have modified many of the substantive claims in Foucault's The History of Sexuality, Volume One: An Introduction. More recently, scholars have attended less to Foucault's substantive claims in favor of his approach to questions of knowledge and subjectivity. ;Feminist, lesbian, and gay scholars have long suspected that gender and sexuality play a major role in authorizing subjects to produce knowledge. Many such scholars continue within existing modes of inquiry to substitute their own, sympathetic versions of their selves for prejudicial, hegemonic versions. Scholars working off of Foucault and other poststructuralist thinkers increasingly suspect that prejudicial assumptions about gender and sexuality lie embedded in the very definition of current modes of inquiry, and thus require a fundamental reconceptualization of knowledge. The ArgumentMany of the epistemological issues that occupied natural philosophers of the seventeenth century were expressed visually in title-page engravings. One of those issues concerned the relative status to be accorded to evidence of the senses, as compared to knowledge gained by faith or reason. In title-page illustrations, the various arguments were often waged by a series of light metaphors: the Light of Reason, the Light of Nature, and the Lights of Sense, Scripture, and Grace. When such illustrations are examined (...) with the authors' theological views in mind, it becomes apparent that in the first half of the seventeenth century, Catholic authors favored the Light of Reason as a source of truth, while Protestant authors favored the Light of Nature. Since by the end of the century it was widely accepted by scientists of all religious persuasions that certain knowledge must be grounded in sense evidence and the direct study of nature, one might argue that in this instance Protestantism was responsible for nurturing an important development of the Scientific Revolution. However, the skewed nature of the sample and the large number of counterexamples available mitigate against taking this offshoot of the Merton thesis too seriously. (shrink)
